Florida Zero Tolerance Law & Under 21 DUI
Under Florida’s “zero tolerance” law, a person under the age of 21 may not operate a motor vehicle with a blood alcohol level of .02% or greater. In fact, Florida statutes authorize law enforcement to lawfully detain a driver under 21 when the officer has probable cause to believe that the driver has any amount of alcohol and/or drugs in his or her system. After detaining the driver, the officer may then request that he or she submit to a breath or blood test to determine his blood alcohol concentration.
It is important to note that being under 21 and driving a motor vehicle with a blood alcohol concentration of .02% to under .08% is not a criminal offense and being “detained” for a blood or breath test does not count as an arrest. This violation is punishable solely by driver’s license suspension. Additional penalties and longer suspension will apply if the driver has a blood alcohol level of .05% or greater or if he or she refuses to take a breath test or blood test.
