Breath and Blood Tests in Broward County, Florida

A breath test, blood test or urine test may play a major role in a DUI (driving under the influence) case. In Florida, it is illegal to operate a motor vehicle while one’s abilities are impaired by alcohol and/or drugs or with a blood alcohol concentration of .08% or greater. A violation of this statute is most often a misdemeanor offense and is punishable by imprisonment, driver’s license suspension, community service, probation and fines.

As experienced DUI defense lawyers, we understand what clients are going through who have taken a breath or blood test and failed. We also represent those who have refused to submit to a chemical test and are facing driver’s license suspension as a result. At Musca Law, our lawyers take on drunk driving cases for clients throughout Fort Lauderdale and the rest of Broward County, Florida. This includes cases involving felony DUI, multiple DUI offenses, underage DUI, commercial DUI and DUI with injury.

Breath and Blood Test Refusals in Fort Lauderdale, Florida

Refusing to submit to a breath test or blood test to determine your blood alcohol concentration, after a DUI arrest, is admissible as evidence in criminal proceedings for your DUI charges. Additionally, refusing a chemical test for a second or subsequent time is a first degree misdemeanor, an offense which may result in imprisonment as well as fines. Any breath or blood test refusal will also result in driver’s license suspension by the Florida DHSMV (Department of Highway Safety and Motor Vehicles). A first refusal may result in a suspension for 1 year. A second or subsequent refusal will result in 18 month suspension. This is covered under Florida’s implied consent law.
